Meeting with the Coordinating Minister for Economic Affairs, Entrepreneurs Request Tapera Regulation Revision

Seven representatives from the Indonesian Employers' Association (APINDO) visited the office of Coordinating Minister for Economic Affairs Airlangga Hartarto. One of the topics discussed was the plan to impose the Public Housing Savings (Tapera) contribution on private sector workers starting in 2027.
APINDO Chairman Shinta Kamdani said that her organization proposed revising the concept of the Tapera contribution. Currently, the implementation plan is outlined in Government Regulation (PP) Number 21 of 2024, which amends PP Number 25 of 2020 on Tapera Implementation, as well as Law Number 4 of 2016 on Tapera.
"The government cannot do much if the law is not revised. So we will provide input for the revision of the Tapera Law," Shinta told reporters at the Coordinating Ministry for Economic Affairs, Central Jakarta, on Tuesday (July 16, 2024).
According to Shinta, Airlangga supports the revision of the Tapera Law. "He (Airlangga) supports that the law itself should be revised first, and that's what we will work on," Shinta said.
Next, the business community will coordinate with the Indonesian House of Representatives (DPR RI) to ensure their input is accommodated. This discussion will likely take place with the DPR RI during the Prabowo Subianto-Gibran Rakabuming Raka administration.
"It looks like that. Because it's pointless if we go back and forth only with the government, but the law remains unchanged. It seems we have to wait for the new parliament," she explained.
The current regulation mandates that by 2027, workers' salaries will be deducted 2.5% monthly, with an additional 0.5% covered by the company. Shinta has previously expressed her objection to making this contribution mandatory for the private sector, arguing it should be voluntary.
"For civil servants, military, and police, that's fine. But for the private sector, although the implementation is planned for 2027, we don't want to wait until then. We need to start working on the revision now," Shinta said.
Additionally, Shinta pointed out concerns about the overlap with a similar program by BPJS Ketenagakerjaan, namely the Additional Service Benefits (MLT). Employers prefer optimizing existing programs over introducing new contributions.
Currently, the burden on employers and workers is around 18.24-19.74%, including deductions for labor insurance, old-age benefits (JHT), death benefits, work accident insurance, pension, social health insurance, and severance reserve. Therefore, Shinta believes that Tapera would increase this burden.
"It does not align with what is already provided by BPJS Ketenagakerjaan and others, as there are related laws as well. So, our principle is to provide input for revising the law. The principle is not about changing the contribution amount but the concept," she said.
